Judgment text excerpt

The Supreme Court held that under Section 6 of the U.P. Industrial Disputes Act, 1947, the State Government lacked authority to extend the time for making an award after the original deadline had passed, rendering the award made on April 13 a nullity. The Court clarified that Section 14 of the U.P. General Clauses Act, 1904, does not confer such power of extension, and any modification cannot have retrospective effect as per Section 21 of the Act. The appeal was allowed, affirming the lower court's decision that the award was made without jurisdiction.
