Judgment text excerpt

The Supreme Court held that a Hindu widow cannot validly surrender her husband's estate in favor of both her daughter and a stranger, as this does not constitute a valid surrender under Hindu Law. The court ruled that such a transaction is not binding on the ultimate reversioners. Furthermore, in a suit by a reversioner to set aside an alienation made by a widow, mesne profits can be awarded from the date of the widow's death, even if the alienation is not void. The judgment also clarified conditions under which mesne profits can be awarded to the reversioner.
