The Supreme Court ruled that mens rea is a necessary element for establishing guilt under the Motor Spirit Rationing Order, 1941, specifically clauses 22 and 25, and the Defence of India Rules, 1939, rule 81(4). The Court held that the licensee of a petrol station could not be convicted for the actions of employees who supplied petrol without coupons if the licensee had no knowledge of the wrongful act. However, under clause 27 of the Order, the supplier is liable if the required endorsements are not made, regardless of knowledge. The appeal was allowed, overturning the conviction of the licensee.
