The Supreme Court held that there is no merger of interests when one of several joint holders of a mokarrari interest acquires a portion of the lakhraj interest, as per the principles established in landlord-tenant law. The Court clarified that a partition among mokarraridars does not affect the integrity of the tenancy, and they remain jointly liable for the entire rent. The appeal from the High Court's dismissal of the suit was therefore upheld, affirming the lower court's decree.
