Judgment text excerpt

The Supreme Court held that under Section 11 of the Bihar Buildings (Lease, Rent and Eviction) Control Act, 1947, the Controller has exclusive jurisdiction to determine non-payment of rent and order eviction. The Court ruled that even if the Controller's decision on non-payment was erroneous, it could not be challenged in a civil court. The appeal from the Patna High Court was dismissed, affirming the Controller's eviction order as final and binding.
