Judgment text excerpt

The Supreme Court ruled that the non-specification of a definite period in a detention order under Section 3 of the Preventive Detention Act, 1950, does not invalidate the order, as per Article 22(4)(a) and (7)(a) of the Constitution. The Court held that the authority's satisfaction regarding the necessity of detention is sufficient, and grounds for detention can be communicated through administrative channels. Furthermore, the past conduct of the detenue can be considered, and mere vagueness in grounds does not constitute a justiciable issue unless it indicates mala fides.
