Judgment text excerpt

The Supreme Court held that Articles 19(1)(f) and 31(1) of the Constitution protect property rights against state action but do not extend to violations by private individuals. The Court ruled that a person whose property rights are infringed by a private entity must seek remedies under ordinary law rather than through Article 32. Consequently, the petition under Article 32 was dismissed as the petitioner misconceived his remedy.
