Judgment text excerpt

The Supreme Court held that the Hindu Law of Inheritance (Amendment) Act (Act II of 1929) applies solely to the separate property of a Hindu male who dies intestate and does not affect the succession of a Hindu female's property, including stridhan. The Court clarified that a maiden's property first devolves to her uterine brothers, then to her mother and father, and subsequently to the nearest sapindas. The ruling established that under both Mitakshara and Mayukha laws, a paternal uncle's son has precedence over a sister's son in inheritance matters.
