The Supreme Court held that the Communal G.O. issued by the Province of Madras, which allocated seats in educational institutions based on community, violated Article 29(2) of the Constitution, which guarantees the right to admission without discrimination on grounds of religion, race, caste, or language. The Court affirmed that directive principles of state policy cannot override fundamental rights enshrined in Part III of the Constitution, thus declaring the G.O. void under Article 13. The judgment of the Madras High Court was upheld.
