The Supreme Court held that the High Court's conclusions regarding the applicability of the Madras Agriculturists’ Relief Act, 1938, were self-contradictory. It ruled that the mortgagor did not cease to be an 'Agriculturist' under Section 3(D) of the Act merely due to the execution sale, and thus was entitled to relief under Section 19 of the Act. The Court reversed the High Court's judgment, confirming that the sale does not become absolute until the appellate court decides on the matter, and clarified that a person does not lose their status as a landholder simply because the estate is under a receiver's control.
