The Supreme Court held that Section 7(1)(c) of the East Punjab Public Safety Act, 1949, which authorized pre-censorship of newspapers, imposed unconstitutional restrictions on the fundamental right of freedom of speech and expression under Article 19(1)(a) of the Constitution. The Court ruled that the law did not pertain to matters undermining the security of the State as defined in Article 19(2), thus rendering it void. The dissenting opinion argued that public safety encompasses the security of the State, but the majority view prevailed, declaring the law unconstitutional.
