Prayer in the present writ petition is for quashing of order dated 28.11.1997 (Annexure P-3) passed by respondent No.1, on an application filed by respondent Nos.3 and 4 under Section 42 of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 for construction of an alternate path. During the pendency of the present petition an application being CM-4166-2011 has been filed by respondent Nos.3 and 4, who had also filed the application under Section 42 of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948.
