HON'BLE SATYA VEER SINGH, J. (Per Arindam Sinha, J.) 1. Petitioner contends, it has set up captive generation of electricity and requires open access for transmission, to use it. Section 9(2) in Electricity Act, 2003 mandates allowing open access. It has challenged communication dated 6th October, 2025 issued by the transmission company, imposing two conditions. Firstly, declaration that there is no pending litigation and secondly, nothing is outstanding as payable by it to the company. Mr. Navin Sinha, learned senior advocate assisted by Mr. Vedant Agarwal, learned advocate appear on behalf of petitioner. Mr. Udit Chandra, learned advocate appears on behalf of respondent nos. 1 and 2 (the transmission company). 2.
