Brief facts of the case are that disputed plot situated at Village Makanpur, Taluka Chauthar, Tehsil Gyanpur, District Bhadohi was recorded in the name of Bachai and Ram Saran. Ram Saran executed a gift deed in favour of Ram Adhar, Lahuri and Phool Chand sons of Maluki. An objection under Section 9 of U.P. Consolidation of Holdings Act, 1953 hereinafter referred to as U.P.C.H. Act was filed by Ram Khelawan (father of respondent no.3) claiming succession of Bachai.
