The petitioner earlier approached this Court by filing Writ A No.15389 of 2025, which was finally disposed of by the Coordinate Bench of this Court vide judgment and order dated November 21, 2025. By the aforesaid judgment the respondents were directed to decide the matter a fresh in view of the law laid down by the Hon'ble Apex Court in the case of Avtar Singh vs. Union of India reported in (2016) 8 SCC 471, Civil Appeal No.5902 of 2012, Ravindra Kumar vs. State of U.P. and others decided on 22.02.2024 and also the judgment of Special Appellate Bench in Special Appeal No.67 of 2023 (Umesh Chand vs. State of U.P.) decided on 24.03.2023.
