(ORAL) Present revision petition has been preferred under Article 227 of the Constitution of India by petitioner-plaintiff being aggrieved by impugned order dated 04.04.2026 passed by learned Additional Civil Judge (Senior Division), Balachaur vide which ex parte proceedings against respondent-defendant No.1, ordered vide order dated 09.05.2024 was set aside, subject to cost of Rs.2,000/-. 2. Respondent-defendant No.1 had sought setting aside of ex parte proceedings and had pleaded that he had suffered severe cardiac arrest in the month of May, 2021 and had undergone angioplasty. Therefore, not being medically fit, he could not appear. 3. Learned Court below after considering the fact that the case is at initial stage, allowed respondent-defendant No.1 to join proceedings by setting aside ex parte proceedings initiated against him.
