In the present writ petition, the challenge is to the order dated 18.05.2023 (Annexure P-1) passed by respondent No.2- Armed Forces Tribunal, Regional Bench, Chandigarh (hereinafter referred to as ‘the Tribunal’) by which, the benefit of counting the service rendered by him in Defence Security Corps (DSC) in 1st and 2nd spell, have been directed to be taken into consideration, so as to compute the pensionary benefits admissible to him. 2. Learned counsel for the petitioners submits that the said benefit granted by the Tribunal is incorrect as there was a gap in 1st and 2nd spell of service rendered by respondent No.1 in DSC and therefore, the same is liable to be set aside. 3 We have heard learned counsel for the petitioners and have gone through the record with his able assistance.
