(ORAL) The present petition has been filed challenging the order dated 02.05.2023 (Annexure P-1) passed by the Armed Forces Tribunal (for short – the ‘Tribunal’) by which, the benefit of war injury pension has been awarded in favour of the respondent keeping in view the fact that the respondent was posted in an counter insurgency area in Jammu and Kashmir during operation Parakaram and while performing active duty, he fell ill and was diagnosed with “Thoracic Outlet Syndrome 173.0 (OPTD). 2. Learned counsel for the petitioners submits that the injury suffered by the respondent is not a Battle Causalty as per the existing policy and therefore, the same will not entitle respondent for the grant of war injury pension which benefit has been given by the Tribunal vide order impugned, though it is a mat
