Annual income of the claimant before the accident was Rs.1,44,000/- (12,000x12). Date of birth of claimant, as per copy of driving licence Ex.P86, was 1.7.1981. Thus, on the date of accident, claimant had completed 38 years of age. Therefore, in view of National Insurance Company Ltd. Vs. Pranay Sethi and others 2017(4) RCR (Civil) 1009 (S.C.), there should be an addition of 40% in income of claimant towards future prospects, as he was below 40 years of age at the time of accident. Calculated thus, the annual income of the claimant works out to Rs.2,01,600/- (1,44,000+57,600). 40. Calculation of compensation for permanent disability thus works out as under :- Annual income before the accident Rs.2,01,600/- Loss of future earning capacity 75% of actual Rs.1,51,200/- income Multiplier with reference to age 15 Loss of future earning Rs.22,68,000/- 41.
