CM-4746-CII-2023 This is an application under Section 5 of the Limitation Act read with Section 151 CPC for condonation of delay of 619 days in filing the appeal. It is mentioned in Para 4 of the present application that:- “2. That the appellant was also not aware regarding the limitation to file appeal for enhancement as they thought that it was a matter of social legislation, and no limitation is applicable as is the case of filing claim petition before the Motor Accident Claim Tribunal. Thus, the delay had occurred because of the lack of funds and for the reasons stated above. The said delay is neither intentional nor malafide but a bonafide one on account of the circumstances mentioned above.” The above-cited reason does not constitute sufficient cause to condone extraordinary delay of 619 days in filing the present appeal.
