State takes exception to the judgment dated 18th December, 2019, whereby, the respondent Deepak has been acquitted of all the charges levelled against him in SC No. 123/2014, in case FIR No. 211/2014 registered at Police Station Mayapuri, under Sections 363/365/366A/342/376 of the Indian Penal Code, 1860 [hereinafter referred to as the “IPC”] & Section 4 of the Protection of Children from Sexual Offences Act, 2012 [hereinafter referred to as (“POCSO Act”)]. The brief facts of the case, as per charge sheet, are that on 09th May, 2014, on receipt of DD No. 24-A, SI Yogesh (PW-14) along with Constable Surender (PW-9), went at the spot i.e. A-11/12, Mayapuri, Phase-I, where, the mother of the prosecutrix (PW-3) met them and gave the statement that her daughter “S” (name withheld), aged about 16 years, has been missing since 4:30 am yesterday. She suspected that some unknown person has lured her away. On such statement, FIR No. 211/2014, under Section 363 IPC was registered at PS Mayapuri. 3.
