Present regular second appeal has been preferred by appellants- defendants being aggrieved by the impugned judgment dated 19.12.2023 passed by the learned District Judge, Jalandhar, whereby the first appeal preferred by the respondent-plaintiff was allowed and the suit for permanent injunction filed by the respondent-plaintiff for restraining appellants-defendant Nos. 1 and 2 from encroaching upon the southern street, shown in red in the site plan of the plaintiff’s house, was decreed. Consequently, the judgment and decree dated 09.02.2021 passed by the learned Additional Civil Judge (Senior Division), Jalandhar, whereby the suit of the respondent-plaintiff had been dismissed, was set aside and the appellants-defendants were restrained from encroaching upon or interfering with the street lying on the northern side of the house of respondent-plaintiff. 2.
