[“IRCON”] after moving from another Central Public Sector Enterprise [“CPSE”], namely Bharat Heavy Electricals Ltd. [“BHEL”], through proper channel with pay protection. His grievance, for which he has instituted the present writ petition, concerns his claim for grant of annual increments with effect from 1st June, 2018 and 1st June, 2019 during his service in IRCON. IRCON has declined to charge these increments on the ground that the Petitioner did not complete his probation period before leaving service. At the relevant time, he was serving as Deputy General Manager (HR), Grade E-6. On 7th November, 2017, BHEL issued a No Objection Certificate permitting him to appear for interview for the post of Additional General Manager (HRM) in IRCON. The NOC also records his service particulars in BHEL, including his designation and pay scale. 3. IRCON issued the Petitioner an offer of appointment dated 17 th November, 2017 for the post of Additional General Manager/HRM, which inter alia provided as follows: “You will be governed by IRCON’s service rules and administrative orders as issued/amended from time to time.” “
