The instant petition has been filed under Section 528 of BNSS 2023 (482 Cr.P.C) with a prayer to quash/ modification of order dated 17.04.2026 passed by ld. Addl.Sessions Judge, Gurugram in Criminal Appeal i.e. CRA/314/2026 whereby the sentence of the petitioner is suspended with the condition to deposit the 20% of the total amount of compensation as awarded by the trial Court, which has been filed against the judgment dated 19.03.2026 passed in NACT 3181 of 2018. 2. Learned counsel for the petitioner contends that the condition of depositing 20% of the amount awarded by the trial Court for hearing the appeal is not compliable as the petitioner is not in a position to pay/deposit the said amount. 3.
