The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to release the pensionary benefits i.e. gratuity and commutation of pension accrued to the petitioner on account of having rendered service for more than three decades with the respondents along with the interest to the tune of 18% interest from the date of his retirement. 2. Learned counsel for the petitioner inter alia contends that the petitioner superannuated on 31.01.2021 (Annexure P-1) and withholding of pensionary benefits despite the quashing of the disciplinary proceedings is illegal and arbitrary.
