Present Regular Second Appeal has been filed by the appellant- plaintiff, impugning the judgment and decree dated 15.01.2026, passed by the First Appellate Court, Bhiwani, whereby the appeal filed by the respondent was allowed, dismissing the suit of the appellant-plaintiff and reversing the judgment and decree dated 04.02.2023, passed by Additional Civil Judge (Senior Division), Bhiwani. 2. Learned counsel for the appellant-plaintiff has raised a limited contention that the First Appellate Court while accepting the appeal filed by the defendants-respondents relied upon the decision of this Court in Mahesh Kumar Vs.
