By way of the present writ petition under Article 226 of the Constitution of India, 1950, the petitioner seeks the following prayers:- “A. That appropriate writ, direction and/or order be issued to the Respondent to allow the Petitioner to renew the registration of their trademark registration application bearing no.- 870775 in Class-07; and/or B. That appropriate writ, direction and/or order be issued to the Respondent directing them to deem the period of validity of registration of a trademark from the date of their actual registration; and/or C. That appropriate writ, direction and/or order be issued declaring that the relevant provisions of Rule 58(2) and 58(3) of The Trade Marks Rules, 2017 are ultra vires to The Trade Marks Act, 1999 and are unconstitutional; and/or D.
