The present appeal has been preferred by the appellants, challenging the Judgment of conviction dated 28.05.2002 passed by the learned Additional Sessions Judge, New Delhi (hereinafter referred to as, the „Trial Court‟), in Sessions Case No. 187/1999, arising out of FIR No. 309/1999, registered at Police Station Kotla Mubarakpur, convicting them of the offence punishable under Section 302 read with Section 34 of the Indian Penal Code, 1860 (hereinafter referred to as „IPC‟). The appellants further challenge the Order on sentence dated 30.05.2002 passed by the learned Trial Court, sentencing them to undergo life imprisonment along with a fine of Rs. 5,000/- each for the offence under Section 302 read with Section 34 of the IPC. In default of payment of the said fine, they have been sentenced to undergo further rigorous imprisonment for a period of six months. 3. At the outset, it is noted that appellant no. 4/Jasvinder @ Sunny passed away on 27.04.2010.
