Present petition has been filed by the petitioner under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking quashing of impugned order dated 13.01.2026 (Annexure P-4) passed by learned Additional Sessions Judge, Hisar, in Criminal Appeal No.40 dated 13.01.2026 titled Rajesh Kumar Vs. Jagjeet Singh, whereby the sentence of the petitioner has been suspended, subject to deposit of 20% of the compensation amount awarded by the learned trial court within 60 days from the date of order. 2. The complaint under Section 138 of the Negotiable Instruments Act, 1881 (for short – ‘the N.I. Act’) was filed by the complainant on account of dishonour of cheque No.830513 dated 24.01.2020 amounting to Rs.12 lakh, which was allegedly issued by the petitioner in favour of the respondent/complainant in discharge of his financial liability.
