Present regular second appeal has been preferred by appellant- plaintiff being aggrieved by the judgment and decree dated 22.12.2016 passed by the Civil Judge (Junior Division), Kalka, whereby the suit for possession and permanent injunction was dismissed and by judgment and decree dated 29.11.2023 passed by the learned Additional District Judge, Panchkula, whereby the first appeal preferred by the appellant-plaintiff was also dismissed. 2. Appellant-plaintiff in his suit for possession and permanent injunction had claimed that respondent-defendant No.1 being the owner of the suit property, had agreed to sell 9 biswas of land situated in village Dharampur, Pinjore, comprised in Khasra Nos. 3, 145/2 and 144/2, for a total sale consideration of ₹16,00,000/-.
