The instant petition under Section 528 BNSS has been filed for quashing of PO order dated 25.07.2018 (Annexure P-3) passed by the learned Judicial Magistrate Ist Class, Gurugram whereby the petitioner has been declared a proclaimed person and FIR No. 1077, dated 22.11.2018 under Section 174-A IPC, 1860, registered at Police Station Shivaji Nagar, District Gurugram (Annexure P-4). 2. Learned counsel for the petitioner submits that a complaint under Section 25 of the Payment and Settlement Systems Act, 2007 was filed by the complainant before the learned Judicial Magistrate Ist Class, Gurgaon. The petitioner failed to appear before the said Court, as a result of which he was declared a proclaimed person in the complaint case and an FIR under Section 174-A IPC, 1860 was registered against him.
