Learned counsel for the appellants submitted that the respondent has expired and the wife of the respondent has furnished an affidavit to the appellants stating therein that 5% cut from the pension of her husband may be made. 2. It has further been stated in the affidavit that one appeal bearing RSA No. 3760 of 2001 is pending before this Court and since her husband expired on 26.02.2011, the family pension and other recoverable dues may be released after recovery of Rs.47,884/-, which is recoverable from her husband. She has further stated that she does not intend to pursue the appeal. 3. Learned counsel for the appellants submitted that, in terms of the aforesaid affidavit, the department has already recovered the due amount from the respondent.
