This is the first petition under Section 483 of the BNSS, 2023 (corresponding to Section 439 Cr.P.C.) for grant of regular bail to the petitioner in FIR No. 728 dated 06.11.2025 (Annexure P-1) U/s 21(c), 29 NDPS Act [Section 111(2)(ii) BNS (New Section) added later on] registered at P.S. City Yamunanagar, District Yamunanagar, Haryana. 2. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has been nominated only on the basis of the disclosure statement of the co-accused. It has been further submitted that the alleged contraband i.e. 1.103 kgs of heroin, was recovered from the co-accused Sartaj and not from the present petitioner.
