The present Regular Second Appeal has been filed against the judgment and decree dated 30.11.1999 passed by the learned Additional District Judge, Gurdaspur. By the said judgment, the appellate court set aside the judgment and decree of the trial court and decreed the suit filed by the respondent/plaintiff, awarding damages to the extent of Rs. 70,000/- along with interest at the rate of 12% per annum from the date of institution of the suit until realization of the amount. 2. Briefly stated, the respondent/plaintiff instituted a suit for recovery of Rs. 1,00,000/- as compensation and damages on the ground that he had been arrested in connection with FIR No. 132/84, registered at Police Station Dhariwal, District Gurdaspur, under Sections 302/34 IPC on 29.10.1984
