SARITA RANI 2026.05.13 18:19 I attest to the accuracy of this document/order RSA-1758-1999 (O&M) 2026:PHHC:074893 4. Admiedly, the defendant entered into an agreement to sell dated 16.07.1990 in favour of the plainffs agreeing to sell the suit land for a total sale consideraon of ₹1,19,000/- at the rate of ₹59,500/- per acre. An amount of ₹30,000/- was paid and received as earnest money on the date of execuon of the agreement itself. The target date fixed for execuon and registraon of the sale deed was 24.08.1990. The agreement also contained the usual reciprocal default clauses. 5.1 According to the plainffs, they had always remained ready and willing to perform their part of the contract and on the spulated date i.e. 24.08.1990, they aended the office of Sub Registrar, Balla along with balance sale consideraon and necessary expenses for stamp and registraon charges, but the defendant failed to appear and execute the sale deed. 5.2 It was further pleaded that the defendant, with an intenon to defeat the rights of the plainffs, got instuted a collusive suit through one Kartara and procured an injuncon order against himself.
