Learned counsel for the petitioner submits that a similar issue came for consideration before the Court where, the direction given for constitution of the Re-Survey Medical Board by the Tribunal vide order dated 09.12.2022 was upheld by this Court by passing an order in CWP No.34614 of 2024 decided on 15.01.2026 titled as Union of India Vs. Lt.Col. Anil Kumar Mago (Retd.) and another. 4. Learned counsel for the petitioner submits that in the aforementioned case, order passed by the Tribunal has granted indulgence so as to allow for constituting a Re-Survey Medical Board despite delay, has already been upheld by this Court and therefore the order passed by the Tribunal in present case, declining indulgence on the ground of delay may kindly be set aside. 5. Learned counsel for the respondent has not been able to rebut the fact that the claim raised to reassess the disability by holding a Re-Survey Medical Board cannot be dismissed on the ground of delay and further the Tribunal in the case of Lt. Col. Anil Kumar Mago’s case (supra), had already granted the indulgence in
