SONIKA 2026.05.26 11:07 I attest to the accuracy and authenticity of this document RSA-313-2023 (O&M) --2-- the judgments and decrees dated 17.09.2019 and 31.03.2022 passed by both the Courts below, whereby, the suit filed at the appellant/plaintiff seeking declaration and permanent injunction came to be dismissed. 2. Briefly stating, the case of the appellant/plaintiff has been that the suit property is a Wakf property belonging to the respondent-Board and was rented out to his predecessor-in-interest, namely Budh, during the year 1966-67 and at that time, the land was quite uneven, un-cultivable, barren but his father made it fit for cultivation by investing huge money. During his life time, Budh remained in actual cultivating possession of land in question as a ‘pattedar’ with the payment of rent regularly. It was pleaded that after the death of Budh on 19.05.1988, the appellant, being his son, stepped into his shoes as ‘pattedar’ in possession of the suit property.
