Judgment text excerpt

DEEPAK KUMAR 2026.05.18 15:32 I attest to the accuracy and integrity of this document CR-3107-2025 -2- property in favour of Badri Nath son of Leela Ram vide decree passed in Civil Suit No.1298 of 1988. 3. The present applicant is wife of Govind Ram Bhatia. She is seeking impleadment. The only ground pleaded for impleadment is that she is residing in the suit property. 4. The petitioner by way of separate suit seeking decree of declaration has impugned the decree dated 22.10.1988 executed by Govind Ram Bhatia in favour of Badri Nath. 5. The right of petitioner is subject matter of separate suit. In the present suit no relief has been claimed against petitioner. Presence of petitioner is not necessary for adjudication of present case. 6. In view thereof, this Court finds that the Trial Court has rightly held that the applicant is neither a proper nor necessary party and has rightly dismissed the application under Order I Rule 10 CPC filed by the petitioner. 7. Resultantly, finding no merit in the present revision petition, the same is ordered to be dismissed. 8. Pending application, if any, shall also stand disposed off.
