The case of the defendant-petitioner is that Original Suit No. 309 of 2020 came to be instituted by the plaintiff-respondent no. 1 before the Court of Civil Judge (Senior Division), Bijnor, being Vinay Kumar Tayal vs. Arun Kumar Tayal, with the allegation that a power of attorney was executed by the plaintiff in favour of defendant no. 1 and, by practicing fraud, defendant no. 1 sold the property to defendant no. 2 on 19.10.2006 and thereafter defendant no. 2 sold the property to defendant no. 3, who happens to be the petitioner herein.
