Heard Sri Manish Kumar Pandey along with Sri Mukesh Dhar Dwivedi, learned counsels for the defendant-petitioners and Sri N.K. Chaturvedi for the plaintiff-respondent. 2. A statement has been made by the learned counsels for the rival parties that they do not propose to file any affidavit, and the petition be decided on the basis of the documents available on record. 3. With the consent of the parties, the petition is being decided at the fresh stage. 4. The case of the defendant-petitioner is that in Original Suit no.230 of 2002, Sabir Husain vs. Udai Pratap Singh came to be instituted before the Court of Civil Judge (Senior Division), Gorakhpur seeking injunction. In the said suit, the defendant-petitioners preferred their written statement along with the counter claim on 17.08.2002. The said suit came to be dismissed in default by the trial court on
