Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has been nominated only on the basis of the disclosure statement of the co-accused. It has been further submitted that nothing has been recovered from the conscious possession of the petitioner as whatever recovery i.e. 07 grams 78 milligrams of heroin alongwith currency notes worth Rs.14,650/-, was effected that was from co-accused Sandeep Kaur.
