The present Petition has been filed under Section 11(5) and (6) of the Arbitration and Conciliation Act, 1996, [“the Act”], seeking the appointment of a Sole Arbitrator to adjudicate upon the disputes inter se the parties. 2. Material on record indicates that the parties entered into an Agreement, being Unit Franchise Agreement dated 19.10.2023, which contains the arbitration clause. The relevant arbitration clause, being Articles 31 and 32 read as under: “ ARTICLE 31 APPLICABLE AND GOVERNING LAW 1. This Agreement and the rights and obligations of the parties hereunder shall be construed and interpreted in accordance with 1996. The Franchisor will be the sole authority to name the Arbitrator.
