(Oral) This is a petition under Section 528 of BNSS, 2023 for quashing of the order dated 20.04.2022 (Annexure P-2) passed by the SDJM, Pehowa in complaint case NACT No.18 of 2017 dated 20.02.2017 titled as M/s Aggarwal B.K.O. Vs. Jitendre Singh @ Bantu, whereby the petitioner has been declared a proclaimed person. The brief facts of the case are that in discharge of his legal liability, the petitioner/accused issued a cheque No.000933 dated 22.12.2016 for an amount of Rs.3,00,000/- in favour of the complainant. The said cheque came to be dishonoured. Pursuant thereto, as no payment was made in lieu of the dishonoured cheque, a complaint under Section 138 of Negotiable Instruments Act came to be instituted against the petitioner/accused and he was summoned to face trial.
