The petitioner has filed the instant petition under Article 226 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to consider the name of the petitioner for promotion to the post of Assistant Director Horticulture as per his seniority from the date of promotion of his juniors. 2. After arguing the case for sometime and realizing that this Court is not inclined to interfere in the matter as chargesheet is still pending against the petitioner and two FIRs have been registered against him and as per the petitioner one FIR has been closed and in the second FIR challan has been presented, learned counsel for the petitioner wishes to withdraw the instant petition. 3.
