(Oral) This petition has been filed for quashing of orders dated 17.09.2004 and 05.07.2005 passed by Additional Sessions Judge, SBS Nagar in case bearing FIR No.41 dated 05.04.2001 registered under Sections 302, 379, 120-B, 148/149 of the Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959 at Police Station Balachaur, District SBS Nagar, whereby the petitioner has been declared a proclaimed offender. Learned counsel appearing on behalf of the petitioner contends that numerous intervening circumstances have taken place post filing of the present petition and that the said facts need to be brought on record, he thus, seeks withdrawal of the instant petition so as to file a fresh petition on the same cause of action with complete and better particulars.
