The present writ petition has been filed under Articles 226/227 of the Constitution of India averring therein that the petitioners have filed an appeal which is pending before respondent No.2 – Joint Development Commissioner, Rural Development and Panchayat (exercising the powers of Commissioner) – along with an application for stay. 2. Learned senior counsel appearing on behalf of the petitioners has stated that though the appeal was filed along with the application for stay as far back as 04.01.2023, however, no orders have been passed on the application for stay despite the appeal being a statutory appeal.
