For convenience, parties hereinafter are referred to by their original position before the Court of First Instance, i.e. the appellant as the plaintiff and respondent No.1 as defendant. Respondent No.7, 8 and 9 were impleaded before this Court only being the purchasers pendente lite. 2. Plaintiff filed suit seeking decree of specific performance of agreement to sell dated 11.06.2003. As per plaintiff, defendant No.1 agreed to sell 08 kanals of land described by boundaries for a total sale consideration of Rs.5 lakhs. He received Rs. 2,50,000/- as earnest money.
