(ORAL) Present revision petition has been preferred under Article 227 of the Constitution of India by the petitioner-defendant being aggrieved by order dated 05.05.2026 (Annexure P-5) passed in CMA-41-2026 by learned District Judge, Fatehgarh Sahib. 2. It is the case of petitioner-defendant that no appeal against order passed by learned Court of First Instance whereby relief of ex parte ad- interim injunction was declined is maintainable. However, learned Court vide order dated 05.05.2026 had not only entertained the appeal but had also restrained petitioner-defendant from interfering into the peaceful possession of the respondent No.1-plaintiff till next date of hearing.
