(Oral) It has been contended by learned counsel for the petitioner that at the time of filing of present petition, any challan was not filed by the Investigating Agency, but now during the pendency of the present petition, challan has been filed beyond the period of limitation. 2. The learned counsel for the petitioner further submits that he wants to withdraw the present petition with liberty to take the abovementioned plea before the learned trial Court at the time of framing of charge. 3.
