The present petition has been preferred under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, assailing the impugned order dated 26.02.2026 (Annexure P-8), whereby the learned Judicial Magistrate Ist Class, Gidderbaha has declared the petitioner as a proclaimed person. 2. Learned counsel for the petitioner submits that FIR No. 102 dated 26.07.2025, registered under section 3(1)(r) of SC/ST Act, at Police Station Kot Bhai, District Sri Muktsar Sahib, was registered. He submits that the proclamation was executed on 25.01.2026 and the case was taken up on 27.01.2025, which is less than the mandatory statutory period of 30 days prescribed under Section 82 Cr.P.C.
